          PLEASE TAKE NOTICE that, pursuant to the Federal Rules of Civil Procedure 37 and 45, and upon the accompanying Declaration of Horace Bowelpool, Esq., dated May 9, 2011, with annexed exhibits, together with the Memorandum of Law submitted herewith, plaintiff Donato Mancini, through counsel, will move this Court to compel non-party Visual Poetics at 2:00 p.m. on May 24, 2011, for an order of the Court to compel non-party Visual Poetics, to comply with plaintiff’s October 10, 2010, subpoena duces tecum. Plaintiff respectfully requests oral argument on the Motion.
          Pursuant local rule wrenching and ravishing and the Court’s Individual Motion Practices, Rule 3(D)(Vu), plaintiff’s counsel and counsel for the non-party Visual Poetics, conferred, agreed that the plaintiff will serve this Notice and accompanying documents on May 9, 2011; the non-party plaintiff will serve this Notice and accompanying documents on May 24, 2011; the non-party Visual Poetics will serve opposition on or before May 25, 2011; and plaintiff will serve his reply, if any, on or before July 4, 2011. Plaintiff will then bundle the motion, movement, memorandum of momentum, method of mollification thereto, and reply in a single filing on or before July 4, 2011.
